Green v. Green

Facts:

The husband instituted an action for divorce from the wife. He charged that the wife had defrauded and deceived him into marrying her and that she had, without just cause, deserted and abandoned him. The trial court entered a decree directing the husband to support, maintenance, and counsel fees to the wife. The husband did not comply and a contempt order was issued. On appeal, a jury found the husband guilty of the charge of willfully deserting, neglecting, failing, and refusing to provide for the support and maintenance of the wife. Subsequently, the husband brought an action for divorce again on the ground of desertion. It alleged that the husband attempted to reconcile with the wife and the wife refused, thus deserting him. The trial court dismissed the action based on res judicata.

It requires them to submit to the ordinary consequences of human infirmities and unwise selections, and the misconduct which will form a good ground for legal separation must be very serious and such as amounts to extreme cruelty, entirely subversive of the family relations rendering the association intolerable.
